Some people believe HIPAA is a solution to privacy rights when it comes to mental health and the whole gun grab problem created by the recent passage of SB7026 in Florida. However it doesn't apply if someone is deemed a danger to himself or others. Mental Health professionals are mandated reporters. Can this mandate be abused? Hell Yes, just ask the VA. Libs would very much like to get rid of HIPAA too and they were on their way to doing so with Obamacare.
Because they (Veterans seeking mental health assistance) have been considered a "danger" to themselves or others by lib counselors at the VA (false claims in many cases) they have to be reported- by law. The Obama administration used this mandate to confiscate weapons from hundreds of thousands of Vets who were no more a danger to society than the cute little kitten stuck in the nearby tree.....it in itself was a form of stealth Confiscation.
I personally advise Vets who are considering using the VA for mental health counseling to bypass the VA and use a private source for this very reason. However to get government assistance for PTSD and other disabling problems, the VA has to make a certification....we have a vicious cycle here. The diagnosis of PTSD in not in itself a diagnosis of danger to self or others unless you're dealing with a VA Obama-era lib who is looking for a bonus or something. The passage of laws to allow Vets to seek their own physicians freely would be a fix for this problem among many others vets experience with the completely inept & corrupt VA.
The recently passed law in Florida SB7026, School Safety Act, is actual law in Florida thanks to knee jerk reactions on the part of a republican controlled state government...hard to believe, to the Parkland Shooting and the following push by lib forces most of which were outside Florida and financed outside of Florida.
In this law due process is removed due to the fact that anyone can now approach a judge and say that someone else is acting bizarre and the judge can court order the removal of guns with no further investigation into the matter. It is the gun owner from that point who then has to prove that he/she is fit to have weapons in the home.
The law says nothing about the government assisting with expenses in that process of proof.....it is a way to get guns out of the hands of law abiding citizens with no recourse on the part of the gun owner who very likely does not have the resources to fight it. In effect we are back to the reality of the gun owner having to prove his/her own innocence, at his/her own expense rather than the court having to prove guilt as the Constitution states. It takes us backward and in many ways wipes out the progress made in Florida last year for gun owners who before in self defense situations were made to prove their innocence in court rather than the other way around. It was almost impossible to fight.
Libs know this and there is no doubt they will use it. Corrupt Government forces, bureaucrats will use this against their political enemies in a heartbeat as soon as they see they can get away with it. We can correctly assume that the law will fail to hold false reporters accountable legally (it will clog the courts, be a long and expensive process for the government, and libs won't do it anyway because they want guns out of the hands of citizens-they will shield these people just like other lib offenders are shielded.) Once this is allowed to happen, we will begin to see the demise of other areas in our lives that libs don't want us to have access to, i.e. free speech (social media, air waves) etc. as these will be seen as inciting "trouble" in society. They have been trying for years to find ways to take guns and shut down our conservative speech. If this law is not corrected and quickly, they have found an inroad.....
We have already seen that Republicans will not do a damned thing about the special treatment libs get when they break the law, tread on the rights of citizens, make false claims, spew their socialist crap on the floor of the house, Senate, wherever, etc. "Social Justice" is another way to allow lib offenders to get off the hook. Libs are still the masters of PR in the social justice arena and republicans either like it or they are still "deer in the headlights" and don't know how to approach it in a way that they can still look good in the politically socially correct arena.
The NRA filed suit on SB7026 right away but they were only citing the restriction on 18-20 year olds purchasing rifles.....
Comprehensive background checks to some may also be a solution however they are a problem as well. The more focused and restrictive background checks become, the harder, more expensive and more time consuming it will be to purchase and own guns. (What happened to "shall not be infringed") First, we have a problem with the NSA collecting data they have no business collecting on average citizens under the guise that they are using meta data to find "patterns" of behavior to track terrorist activity down.
Does anyone in this nation believe that government forces are getting rid of the collected data they had no right to collect in the first place? Only the must gullible libs.
Therefore does anyone really believe that they are getting rid of background check information or keeping it private from other agency eyes as they are supposed to once the check is passed? Please....if anyone believes that I have a bridge to sell in Brooklyn. The government has a seriously long road to travel if they ever want to regain trust with the citizenry and I personally think they could care less if they have the trust of the public.
I believe wholeheartedly that this information is kept and is a way to track those who at least are attempting to buy a gun. It can be used in the future under another lib regime....Obama's was on the way to doing just that.
Let's look at the facts:
No background check would have applied to the kid in Parkland....he was a minor, law enforcement at the local, state and federal levels were purposefully ignoring his openly bizarre and illegal behavior, and the weapon wasn't his. He has never been background checked.
How many criminals do you think go and get a background check to obtain their weapons? ZERO, they steal or buy them under the radar.
Restrictions on guns ALWAYS apply to the law abiding citizen....there are no exceptions here. The fact is where gun owners are least restricted in ownership, the least gun crime occurs....in areas where there are strict gun control laws, the most gun crimes occur (and other crime for that matter). If we would take the protection of our kids seriously, schools would cease being shot up. Criminals are much less likely to offend in places where the chances of them being caught, injured or killed are higher. They are predators....predators in the human and animal kingdom look for weakness before they strike. They never strike strong targets unless they are desperate.
Those lib-backed kids walking out of school to pressure politicians for gun control were a joke.
Parents should get together and go on "strike" keeping their kids out of school en masse until the schools begin to take the protection of kids seriously. These same parents should take their kids and go sit in the parking lot and lobby of their county School Board office educating their children themselves until the school boards get off their sorry butts and fix the problem. They should have armed guards on hand during the process and then the kids won't be breaking the law by not being in school and they will be protected at the same time, and as a bonus a stubborn and uncaring school board will be highly embarrassed and hopefully correctly kicked out of office.
THAT would be the correct reaction to the Parkland Shooting. The problem in Parkland (Broward County?) ....Full of libs who believe Government is the answer to their problems and like the cattle they are will do whatever they are told. They see obeying the government as more important than protecting their own babies and so they will continue to send their children to government schools unprotected.
There are multiple ways to educate kids now....FL Virtual School, Homeschooling, private charter school, etc. Public school is only one option now....time for parents to get involved and make some changes themselves.
The nation must stop being afraid of guns and begin openly teaching children (as we once did) to respect them, to use them properly. It's funny how the libs were able to convince us that we couldn't stop kids from having sex/babies and at the same time convince us that guns were something to fear, that kids should never see them, that society should be afraid of them and that only certain people should have guns.....the inroads they have been able to make into our society are amazing....and scaring.
This new law has me just a little ticked off......
